Welcome to the website www.batman-escape.com, presentation and reservation site of the Hangar de la Villette, escape game (life-size games) in Paris. We invite you to read carefully the present General Terms and Conditions of Use and Sale as well as our Personal Data Protection Policy in order to be able to browse and book on our website. The use of the services of our website as well as any reservation implies the prior, full and complete acceptance of the present General Conditions of Use and Sale and of our Personal Data Protection Policy of which you acknowledge having read.

The present General Conditions of Use and Sale (the "General Conditions") are concluded between LE HANGAR DE LA VILLETTE ("LE HANGAR DE LA VILLETTE" or "us") and any natural person, not a merchant (the "Customer"), wishing either to make a reservation, whether he/she makes a reservation personally or whether he/she is a member of the team of the person making the reservation, or to offer a gift card on the internet site www.batman-escape.com (the "Site")

For the application of the General Conditions, it is agreed that the Customer and LE HANGAR DE LA VILLETTE will be collectively called the "Parties" and individually called the "Party".

The reservation on the Site is exclusively reserved for retail reservations. In no case, the Site can be used by professional sellers, alone or grouped together and this, whatever the mode of marketing of their products (marketplaces on the Internet, shopping malls, intermediaries, physical stores in particular). You recognize and accept consequently that our reservations can be realized only in limited quantities and this with regard to the number of reservations passed on the Site. LE HANGAR DE LA VILLETTE reserves the faculty to refuse a reservation obviously validated by a professional salesman.

1.1 LE HANGAR DE LA VILLETTE is a concept of game of escape size life (escape game) belonging to the company LE HANGAR DE LA VILLETTE. The purpose of the General Conditions is to fix the rules of use of the Site and to govern the reservation and the provision of our missions of escape game on the Site.

Thus, you agree, during each of your visits to the Site, to respect the General Conditions that apply to all services available on the Site, whether they are provided free of charge or sold.

Consequently, you accept the whole of the General Conditions before any purchase, consultation of information, simple free use of the Site and/or any reservation, whatever the means of reservation, that this one is carried out via the Site or with the personnel of the company LE HANGAR DE LA VILLETTE.

1.2 LE HANGAR DE LA VILLETTE is free to modify the General Conditions at any time in order to adapt them to the evolutions of the Site and/or the legislation. The new General Conditions are applicable as soon as they are put online on the Site.

You are therefore advised to regularly refer to the latest version of the General Conditions available at all times on the Site and to cease its use in case of disagreement with the General Conditions in force.

However, the General Conditions applicable are those in force on the day of the reservation by the Customer.

1.3 Any condition, contrary to the General Conditions, requested by the Customer and not accepted by LE HANGAR DE LA VILLETTE is not opposable to us.

1.4 The fact that LE HANGAR DE LA VILLETTE or the Customer does not avail itself at a given moment of any of the clauses of the General Conditions cannot in any case be interpreted as a renunciation, by LE HANGAR DE LA VILLETTE or the Customer, to avail itself later of any of the said clauses.

2.1 The equipment (computers, telephones, software, telecommunication means...) allowing access to the Site are at your exclusive charge, as well as the telecommunication costs incurred by their use.

2.2 You commit yourselves not to undermine the rights of the company LE HANGAR DE LA VILLETTE and you oblige yourselves to :

• use and/or download the information on the Site on your equipment for personal, non-commercial and time-limited use only;
• print the downloaded information on paper only on the condition that the copies thus made are for personal use only, which excludes in particular any reproduction for professional or commercial purposes or mass distribution, whether free of charge or not;
• not to copy and/or reproduce all or part of the Site, in particular on another site, another application or an internal company network;
• not to reproduce, reuse, summarize, alter, modify, move, extract, replace, store, rebroadcast, represent or retain, directly or indirectly, on any medium whatsoever, by any means and in any form whatsoever, all or part of the information and / or reproductions (illustrations, photos ...) appearing on the Site and / or the name, logo (s) and trademarks of the company LE HANGAR DE LA VILLETTE or any third party ;
• to set up control systems adapted to technical developments to avoid any "piracy" of the Site and in particular to avoid the illicit use or use contrary to the General Conditions of all or part of the information and reproductions appearing on the Site in any way and in any form whatsoever;
• to inform LE HANGAR DE LA VILLETTE as of the knowledge of a "piracy" and in particular of any illicit or non-contractual use of whole or part of the Site and this, whatever the mode of diffusion used.

2.3 You must not use any device, software or program that interferes or attempts to interfere with the proper working of the Site.

More generally, you agree, each time you use the Site, to behave in a normal and reasonable manner and not to hinder, in any way whatsoever, its proper functioning.

In particular, you agree to:

• not to disrupt, slow down, block or alter the normal flow of data exchanged in the course of using the Site;
• not to accelerate the rate of scrolling of the contents of the Site in such a way that its functioning is modified or altered;
• not to commit any other action having an equivalent disruptive effect on the functionality of the Site;
• not to fraudulently access, maintain, interfere with or disrupt the Site's access systems

3.1 LE HANGAR DE LA VILLETTE grants to the Customers and to the persons participating in the mission of escape game the right to occupy a space of play to fulfill a mission of escape game for a maximum duration of 70 (seventy) minutes. The occupation of the space of play has for only and unique purpose to take part in the mission of escape game organized by LE HANGAR DE LA VILLETTE, which must be realized in team of 3 to 6 people maximum.

Clients and participants in the escape game mission agree that they may remain in the game space for up to 70 minutes, regardless of whether they have managed to find all the clues and solve all the puzzles. This point is part of the principle of the escape game. Clients and participants in the escape game agree that the game may end before the end of the 70 minutes, especially if they have managed to find all the clues and solve all the puzzles in less than 70 minutes; without this being subject to any adjustment or compensation.

3.2 The complexity of the escape game mission does not allow people under the age of 7 to participate. Minors under the age of 13 must be accompanied by an adult. In case of doubt on the age of a person, LE HANGAR DE LA VILLETTE reserves the right to ask for a proof of identity.

3.3 Customers and persons participating in the escape game mission are required to maintain the game space and all of its equipment (non-restrictive list: decorations, furnishings, etc.) in good condition and to use it in accordance with its authorized use. The Customer acknowledges that any intentional or unauthorized damage to the game space and its equipment will be billed.

The Customer and the people taking part in the mission of escape game are held to use the space of play and its equipment so as not to cause or risk causing any damage to the other people taking part in the mission of escape game, the buildings and the materials of the company LE HANGAR DE LA VILLETTE.

During all their presence within the buildings of the company LE HANGAR DE LA VILLETTE, the Customers and the people participating in the mission of escape game commit themselves to behave in a respectable way, to conform to the rules and to cooperate with the personnel of the company LE HANGAR DE LA VILLETTE.

LE HANGAR DE LA VILLETTE does not tolerate any form of violence, whether verbal or physical, in the form of harassment or intimidation, and thus reserves the right to refuse access to the premises to any person whose behavior is inappropriate. LE HANGAR DE LA VILLETTE also reserves the right to refuse access to any person under the influence of alcohol or drugs and this for safety reasons. For all the conditions mentioned above, the prohibition of access does not give right to any compensation or refund.

3.4 No recording may be made in the game area. Thus, the use of video and/or audio recording devices (including but not limited to cell phones, cameras, Go Pro, etc.) is strictly forbidden. Any use of such devices may result in the complete termination of the escape game mission for all participants.

LE HANGAR DE LA VILLETTE expects from its Customers and from the persons participating in the mission of escape game that they do not reveal the details of the game in a direct and/or indirect way.

3.5 Our reservation offers and their prices are valid, in the absence of any indication of a particular duration, as long as they are visible on our Site, within the limit of available reservations.

In the exceptional eventuality of an unavailability of one or several missions after the making of your reservation, you will be informed immediately by e-mail. In this hypothesis, you will be refunded of the sums which you will have paid at the latest in the 14 days as from the sending by LE HANGAR DE LA VILLETTE of the e-mail notifying you of the unavailability of the mission of escape game (game of evasion).

3.6 Each mission will have a description sheet that will mention: the level of difficulty, the time needed to complete the mission, the number of players that can complete the mission as well as its other essential characteristics.

The rates of the missions are indicated in the tab " Booking " of the Site.

The photographs presenting the escape game missions on the Site are provided for illustrative purposes only.

In case of doubt or if additional information is required, the Customer may contact the Customer Service Department whose contact details are given in Article 8.

3.7 LE HANGAR DE LA VILLETTE makes a commitment to organize missions of escape game in conformity with the whole of the European and French regulations in force relating in particular to the regulated chemical substances, the safety and the health of the people.

4.1 The prices of our missions of escape game appear on the Site and in the buildings of the company LE HANGAR DE LA VILLETTE in euros. They are indicated in the tab "Information - Prices" of the Site. They are degressive rates according to the number of players per room. The prices are indicated all inclusive of tax (TTC), the applied VAT being that of the day of the reservation.

4.2 The price of our escape game missions is the one in effect on the day of the reservation. In the event of a price promotion, we undertake to apply the promotional price to any reservation made during the promotion period.

We reserve the right to change the price of our escape game missions at any time. However, escape game missions will be invoiced on the basis of the prices in effect on the day of the Customer's reservation.

We inform you that in case of display of an erroneous price, obviously derisory compared to the real value of the provision of the game space allowing the realization of the mission of escape game, whatever the reason (computer bug, manual error, technical error), the reservation even validated by us will be cancelled, of which we will inform you as soon as possible. You will then be able, if you wish, to make a new reservation at the corrected and exact price.

5.1 Reservations on the Site

The contractual information and the General Conditions are presented on the Site in French.

To make a reservation on the Site, you must identify yourself (email address, name and telephone number).

The different steps to follow to make a reservation on the Site are the following:

• Choice of the escape game mission,
• Selection of the date and time slot,
• Indication of the name, email address and telephone number of the Customer,
• Choice of the number of players,
• Selection of the mission language (French or English),
• Confirmation of the reservation by clicking on the "BOOK" button and acceptance of the General Conditions and the Site's Personal Data Protection Policy,
• Receipt, upon validation of the reservation, of an email acknowledging receipt of the reservation.

Before validating each step of the reservation and until payment is received, the Client can view the details of his reservation, his choice of mission and number of players as well as the total price and return to the previous pages to correct any errors or modify his order.

5.2 The reservation becomes final only when it was the object of a confirmation by LE HANGAR DE LA VILLETTE by the sending of an e-mail of confirmation of the reservation (recapitulating the whole of the past reservations, the paid price, the date of the reservation and the General Conditions) to the e-mail address that the Customer will have communicated on the form of registration mentioned in article 5.1.

5.3 LE HANGAR DE LA VILLETTE reserves the right to cancel or refuse the reservation made by the Customer in the presence of one of the following legitimate reasons

• Failure to pay for the reservation,
• in the event of a dispute with the Client concerning the payment of a previous reservation,
• if the quantities of reservations made are abnormally high for a non-trading Customer,
• the information required for the payment of the reservation is erroneous or cannot be verified,
• the Customer is not 18 years old.

5.4 The confirmations of electronic reservations (which are worth contract of sale between the Parties) addressed to the Customers are archived by LE HANGAR DE LA VILLETTE on a reliable and durable support and are preserved during 10 years as from the date of reservation. They can be requested by writing to the Customer Service whose coordinates appear in article 8.

LE HANGAR DE LA VILLETTE gives the possibility to the Customer to reserve a mission of escape game for the account of another person (the Beneficiary) by ordering a gift card.

6.1 Placing orders and purchasing gift cards on the Site

The contractual information and the General Conditions are presented on the Site in French.

The different steps to follow to order on the Site are the following:

• Choice of the amount of the gift card and addition to the basket after having informed the email address of the Beneficiary and the name of the Customer and selected the desired quantity,
• Summary of the gift cards ordered - If the Customer has a benefit code, he/she must enter it in the space provided for this purpose in order to benefit from it - and validation,
• Customer's billing details: Last name, First name, Company name (optional), Country, Address, Phone, Email,
• Choice of creating an account (see 6.5),
• Validation of the order with the total price of the order,
• Confirmation of the order by clicking on the "ORDER" button and acceptance of the General Terms and Conditions and the Site's Personal Data Protection Policy,
• Choice of the payment method (by credit card or PayPal account) - Validation of the payment,
• Receipt, upon validation of the payment, of an email acknowledging receipt of the order and its payment.

Before validating each step of the order and until payment is received, the Customer can view the details of his order, his choice of payment method as well as his total price and return to the previous pages to correct any errors or modify his order.

In case of non-validation of the order by the Customer, the contents of the basket remain accessible for a period of (to be completed) days, thus allowing, if necessary, its subsequent validation.

6.2 The order becomes final only when it was the object of a confirmation by LE HANGAR DE LA VILLETTE by the sending of an e-mail of confirmation of the order (recapitulating the whole of the ordered gift cards, the address of invoicing, the paid price and the General Conditions) to the electronic address that the Customer will have communicated at the time of the choice of the amount of the gift card mentioned in article 6.1.

6.3 LE HANGAR DE LA VILLETTE reserves the right to cancel or refuse the order placed by the Customer in the presence of one of the following legitimate reasons:

• Failure to pay for the order,
• in the event of a dispute with the Customer concerning the payment of a previous order or for abnormal or abusive returns,
• if the quantities of gift cards ordered are abnormally high for a non-trading Customer,
• the information necessary for the payment of the products and/or their delivery is erroneous or cannot be verified,
• the Customer is not 18 years old.

6.4 The confirmations of electronic orders (which are worth contract of sale between the Parties) addressed to the Customers are archived by LE HANGAR DE LA VILLETTE on a reliable and durable support and are preserved during 10 years as from the date of delivery of the products. They can be requested by writing to the Customer Service whose coordinates appear in article 8 or consulted on the account of the Customer.

6.5 Creation of an account and terms of its closure

6.5.1 When placing an order for a gift card on the Site, the creation of a customer account is possible.

To do this, you must fill out a registration form online, which must be filled out (indicated by an asterisk) in order to access certain sections and/or services on the Site. If you do not provide the information mentioned as mandatory, the creation of your account will be impossible.

When creating your account, you agree to provide true, accurate and complete information and to keep it up to date without delay.

In the hypothesis where you would provide false, inaccurate, out-of-date or incomplete information, LE HANGAR DE LA VILLETTE will be entitled not to follow up on your request to open an account.

You are also responsible for all financial consequences resulting from the use of the Site on your behalf but also on behalf of third parties including minors, unless you can demonstrate fraudulent use not resulting from any fault or negligence on your part.

To create an account, you must have a valid email address.

6.5.2 When creating your account, you are required to choose access codes (an email address and a password) that are personal to you. Your access codes allow you to identify yourself and access your account at all times.

You are responsible for maintaining the confidentiality of your account and access codes. Unless proven otherwise, any connection to the Site or transmission of data using your access codes will be deemed to have been made by you.

Consequently, you undertake to keep your access codes secret and to refrain from disclosing them in any form whatsoever to third parties. In this respect, you have the possibility to explicitly disconnect at the end of each session.

In the event of loss, theft or accidental disclosure of your access codes, you must immediately notify Customer Service whose coordinates are given in article 8, by e-mail which will proceed to the cancellation of your access codes as soon as possible. The Customer will then be able to choose new access codes online

6.5.3 Your account allows you, in addition to placing orders on the Site, to consult the history of your purchases made on the Site, your invoices and order confirmations and to be able to download them as a pdf file from your account.

6.5.4 Each Customer is free to close his account on the Site at the end of each purchase made. To do this, he must send an email to the Customer Service whose coordinates appear in Article 8 indicating that he requests the deletion of his Account.

LE HANGAR DE LA VILLETTE reserves the right to close the account of any Customer who would have contravened the General Conditions or any inactive account since at least 2 years. The said deletion will not be likely to constitute a damage for the Customer who will not be able to claim any compensation of this fact. This suppression is not exclusive of the possibility, for LE HANGAR DE LA VILLETTE, of undertaking legal proceedings against the Customer, when the facts will have justified it.

Whatever the reason for the closure of the Customer's account, the latter will be notified of the deactivation of his account by e-mail or by post. The Customer will no longer be able to place orders on the Site from the effective date of the account closure.

7.1 The payment of the products ordered on the Site can be made :

• or by credit card (Carte Bleue, Visa, Eurocard/Mastercard/American Express) directly on the Site. The debit of the card is carried out as of the taking of order except in the event of unavailability of the servers. In this hypothesis, LE HANGAR DE LA VILLETTE reserves the right to proceed to a new request for authorization of debit in the case where the first one could not succeed because of unavailability of the servers.
• or with your Paypal account. By choosing the payment via Paypal, you will be automatically directed to your Paypal account. Once the Paypal payment is validated, you will be able to complete your order on the Site.

7.2 Transactions made on the Site are secured by the payment system of our partner, Société Générale. All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time your financial data pass in transit on the computer system of the company LE HANGAR DE LA VILLETTE.

In the event of fraudulent use of your means of payment, you are invited, as soon as you notice this use, to contact the Customer Service Department, whose contact details are given in Article 8.

7.3 An invoice will be sent to the Customer automatically by e-mail.

7.4 Finally, in case of delay or default of payment, LE HANGAR DE LA VILLETTE will be able to suspend all the orders in progress until the regularization of the situation, without damage of any other way of action.

The Customer service of the company LE HANGAR DE LA VILLETTE is at the disposal of the Customer for all questions relative to his reservation, his order of gift card, their payment and the follow-up of the commercial relations.

9.1 Escape game missions constitute leisure activities that are provided on a specific date or period, as defined in article L 221-28 12° of the French Consumer Code.

Consequently, the Customer does not have the right of withdrawal concerning the reservations of missions of escape game.

9.2 In accordance with the provisions of Article L 221-18 of the French Consumer Code, the Customer has a right of withdrawal for the order of gift cards under the following conditions:

The Customer can exercise his right of retractation, without reason, nor expenses, within 14 clear days as from the reception of the e-mail by which LE HANGAR DE LA VILLETTE confirms him the acceptance of his order.

The right of retractation can be exerted as of the order on line of the gift card without even waiting for the email of the company LE HANGAR DE LA VILLETTE confirming the order of the Customer.

When the 14-day period expires on a Saturday, Sunday, or statutory or civic holiday, it is extended to the next business day.

The Customer can exert his right of retractation by the sending of the standard form of retractation or any other declaration without ambiguity and expressing his will to retract to the following postal address LE HANGAR DE LA VILLETTE - 30 avenue Corentin Cariou - 75019 Paris- France. An e-mail could also be addressed to the e-mail address: contact@batman-escape.com

This refunding will be carried out as soon as possible and at the latest in the 14 days as from the date on which LE HANGAR DE LA VILLETTE was informed of the decision of the Customer to retract. The refund will be made according to the initial mode of payment used by the Customer at the time of his order.

9.3 WITHDRAWAL FORM

You are invited to refer to the "Privacy Policy" section of the Site to obtain all the necessary information about the processing of your personal data and our policy on cookies.

11.1 LE HANGAR DE LA VILLETTE is responsible towards the Customer for the good execution of his reservations and orders of gift cards passed on the Site.

However, LE HANGAR DE LA VILLETTE will not have failed in its contractual obligations insofar as their execution will have been delayed, hindered or prevented by a fact imputable to the Customer or resulting from the fault of this last one or of the fact, unforeseeable and insurmountable, of a third. The same shall apply in the event of any inconvenience or damage inherent in the use of the Internet network in accordance with Article 11.3 or a case of force majeure as defined in Article 12.

11.2 The missions proposed on the Site are in conformity with the European regulations as well as the French legislation in force. LE HANGAR DE LA VILLETTE does not give any guarantee of conformity to the local legislation which would be applicable to you, as soon as you reach the Site from other countries.

In the same way, LE HANGAR DE LA VILLETTE cannot guarantee that the missions will answer all your expectations, but only that they will be in conformity with the essential characteristics such as described on the Site.

11.3 LE HANGAR DE LA VILLETTE commits itself to make its best efforts to secure the access, the consultation and the use of the Site in accordance with the rules of use of the Internet. However, we cannot guarantee that the Site will be free of anomalies, viruses, errors or bugs, nor that these can be corrected, nor that the Site will function without interruption or breakdown, nor that it will be compatible with any computer equipment or particular configuration.

The Site is accessible 24 hours a day, 7 days a week, except in the event of force majeure or the occurrence of an event beyond the control of the company LE HANGAR DE LA VILLETTE and subject to possible breakdowns and maintenance interventions necessary for the good functioning of the Site.

Maintenance work may be carried out without prior notice to you.

You declare that you accept the characteristics and limits of the Internet, and in particular its technical performance, the response times for consulting, querying or transferring data and the risks associated with the security of communications.

In this regard, you acknowledge that:

• your use of the Site is at your own risk; the Site and its content are accessible to you "as is" and according to its availability;
• you are responsible for any damage to your equipment and/or loss of data that results from downloading or viewing the Site;
• It is therefore your responsibility to take all appropriate measures to protect your own data and/or software from contamination by any viruses circulating on the Site;
• no advice and no information, that they are oral or written, obtained from the company LE HANGAR DE LA VILLETTE or during the use of the Site are likely to create guarantees not expressly envisaged by the General Conditions;
• you are solely responsible for your use of the Site;
• the communication of your access codes or in a general way of any information considered confidential is made under your own responsibility;
• It is your responsibility to take all necessary measures to ensure that the technical characteristics of your equipment allow you to consult the Site.

Neither the Customer nor LE HANGAR DE LA VILLETTE will have failed in its contractual obligations insofar as their execution will be delayed, hindered or prevented by a case of absolute necessity such as defined by the article 1218 of the French Civil code.

In such a hypothesis, LE HANGAR DE LA VILLETTE will inform the Customer of the occurrence of such an event within 3 working days following its occurrence, by electronic mail.

After a period of 30 days and in the event that the event constituting force majeure persists, the order will be cancelled and will be subject to a refund within a maximum of 14 days.

13.1 All the marks, logos, other distinctive signs, the visuals, photos, texts, comments, illustrations, drawings and images reproduced on the Site are the object of royalties and intellectual property rights. Any total or partial reproduction of these elements and of the Site is thus strictly prohibited, without the preliminary and written agreement of the company LE HANGAR DE LA VILLETTE.

13.2 The Customer commits himself not to use the products, the contents of the Site as well as the whole of the information brought to his knowledge in a way likely to attack the rights of the company LE HANGAR DE LA VILLETTE and that their use never constitutes a counterfeit or an act of unfair competition.

14.1 THE GENERAL CONDITIONS HAVE BEEN DRAWN UP IN THE FRENCH LANGUAGE WHICH WILL BE CONSIDERED AS THE INDICATED LANGUAGE OF THE PARTIES.

14.2 THE INTERPRETATION AND THE EXECUTION OF THE GENERAL CONDITIONS, AS WELL AS ALL ACTS AND CONVENTIONS WHICH WOULD BE THE CONTINUATION OR THE CONSEQUENCE LIKE ALL CLAIMS AND LITIGATIONS BETWEEN THE PARTS, WILL BE SUBJECTED TO THE FRENCH LAW AND THIS WHATEVER THE NATIONALITY OF THE CUSTOMER.

14.3 IN CASE OF DISPUTE, AN AMICABLE SOLUTION WILL BE SOUGHT. THE CUSTOMER IS KINDLY REQUESTED TO CONTACT IN WRITING THE CUSTOMER SERVICE WHOSE COORDINATES ARE LISTED IN ARTICLE 8, INDICATING HIS NAME, SURNAME, POSTAL ADDRESS, EMAIL ADDRESS AND ORDER REFERENCE.
